1. Acceptance of Terms
By accessing and using The Exchange ("Service"), operated by The Musicians Club, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.
2. Description of Service
The Exchange is a peer-to-peer marketplace for buying and selling musical instruments, audio equipment, and related accessories. We facilitate connections between buyers and sellers but are not a party to the transactions themselves.
3. User Accounts
You must create an account to sell on The Exchange. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate, current, and complete information during registration.
4. Listings and Sales
Sellers are responsible for the accuracy of their listings, including descriptions, condition grading, and photos. All listings are subject to review. We reserve the right to remove listings that violate our Community Guidelines. A 10% commission is charged on completed sales.
5. Buyer Protection
Purchases are covered by our Buyer Protection program. Buyers have a 72-hour inspection window after delivery to report items that are not as described. Refund decisions are made at our discretion based on the evidence provided.
6. Prohibited Conduct
Users may not: list counterfeit or stolen items; misrepresent the condition or identity of items; manipulate ratings or reviews; complete transactions outside the platform to avoid fees; harass other users; or use the platform for any unlawful purpose.
7. Limitation of Liability
The Exchange facilitates peer-to-peer transactions and is not responsible for the quality, safety, or legality of items listed. We are not liable for any loss, damage, or injury resulting from transactions between users. Our liability is limited to the fees collected on the specific transaction in dispute.
8. Termination
We reserve the right to suspend or terminate accounts that violate these terms or our Community Guidelines. Users may close their account at any time by contacting us. Outstanding obligations (pending orders, payouts) must be fulfilled before account closure.
9. Changes to Terms
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. Material changes will be communicated via email or platform notification.
